Estate administration & probate assistance
Sometimes things change, and you need to update your will or other documents accordingly. If we prepared your latest documents, we can amend these for you. If we did not prepare your latest documents, then the service you require is the Drafting wills & estate planning documents, and we will discuss a fixed price with you based on the amount of work required to transfer your documents to our model and make the changes you require.

Complex estate planning
Sometimes a will is not enough, and you need a solicitor who will work with you and perhaps your financial advisor or accountant to construct an estate plan that fits in with your current structures. Binding financial agreements
While we believe that consent orders are a great way to proceed for property settlements, they do no suit all matters. Sometimes you might be better served by a financial agreement, and we have you covered for that too. We can draft or reviewing post-separation or de-facto financial agreements.
We do not, at this stage, offer pre-separation agreements or “pre-nups”

Procedural advice for self-represented litigants
Step-by-step explanation of what happens next in your court matter and what to expect at Court events, assistance finding case law, legislation and evidence, issuing subpoenas, inspecting subpoenas, planning cross-examination and when to know if you might need a lawyer involved.
This matter is designed for assistance in setting up and planning your matter, and is not a substitute for an advice conference. The solicitor will not weigh up your prospects based on what has happened in your matter to date

Consent Orders
If you’ve reached an agreement on property or parenting matters, consent orders can be a great way to move forward.
Consent orders are sealed by the Court (although you do not usually need to attend the Court in person) and are enforceable, helping to make sure that what you have agreed to is what occurs.
We’ll prepare or review consent orders so everything is clear, compliant and enforceable.

Binding Child Support Agreement
From time to time, the rate of child support calculated by Services Australia does not meet your needs. This might be the case where you and the other party have agreed to a lump sum in lieu of child support, or if you have arrangements for the payment of private school fees or private health cover. We can assist you to prepare or review a binding child support agreement that is then lodged with Services Australia for alternate child support arrangements.

Settlement Advice
So you have reached a settlement with the other party, but are not sure what the fine print should be. Divorce Application
A divorce application can be made through the Commonwealth Courts Portal once you have been separated for more than 12 months. You can lodge this yourself, and the Federal Circuit and Family Court of Australia website has a lot of guidance as to how to do just that. We have also prepared a blog doing the same. Unfortunately, however, the filing fee for a divorce is expensive, and if you get it wrong there is a chance your application will be rejected or lapse and you will need to start again and pay a new filing fee. To avoid such an issue, sometimes people prefer to have their divorce prepared by a lawyer, and we can help with that.

Ongoing executor support
Most executors are not legal experts – they’re usually next of kin or a trusted friend – so some legal support can be very valuable. If you have already attended an assistance appointment, and have some more questions, this is the service for you. We offer as-needed guidance for executors managing an estate from first steps to final distribution.

Estate administration
These days many executors hire a solicitor (with the estate paying) to carry out the estate administration. We offer a hybrid model that leaves you in control of the estate bank account (rather than receipting funds into our law practice trust account), while taking the leg work of preparing forms, liaising with beneficiaries and third parties, and preparing the distribution spreadsheet. We also provide you written advice along the way and are happy to meet with you or take your calls or emails as needed.

Probate or Letters of Administration Court Forms
Where a person leaves a house, some shares or a bank account over a certain value, then it may be necessary to apply to the Supreme Court of the relevant state or territory for a grant of Probate or Letters of Administration. We can handle the Court forms for you and send these to you for your signature. We can also assist you to respond to any questions (requisitions) raised by the Court. Our fees are charged based on the NSW Probate Schedule published each year.
